By accessing, browsing or using this website, you agree to all terms, conditions and disclaimers.

The Hamper Spot reserves the right to amend these Terms and Conditions at its sole discretion. Any amendment is effective immediately.

Delivery

Once an order is confirmed, The Hamper Spot will send dispatch and delivery details to the email address provided. The Hamper Spot uses reputable third party couriers, including Couriers Please and Australia Post. Whilst every care is taken to ensure accurate and safe delivery, The Hamper Spot can not guarantee that goods will not be damaged as a result of unforeseen circumstances or circumstances which are out of The Hamper Spot’s control, such as damage sustained during delivery, theft or delay that results in a parcel not arriving at the intended delivery address at the intended time and place.

When you spend $250 or more, delivery is free Australia wide. Any purchase less than $250 will incur a delivery charge. Please note that corporate orders (consisting of multiple gift boxes) that are being delivered to multiple/different addresses will be charged a delivery fee PER ADDRESS if the order to each address is under $250AUD.

Delivery Times

DELIVERY DATES – COVID-19 (UPDATED NOVEMBER 2021)

Extensive delays with deliveries due to courier delivery times (minimum 48 hours on top of the general delivery times, listed below). Please allow as much time as possible for delivery when placing an order. We are unable to guarantee your requested delivery date will be met during this exceptionally busy time. This is unprecedented and we will do our best to dispatch your order as soon as possible. Please note that once the package has left our premises, we are unable to obtain it until it has reached a deport, or is in the van on the way to your recipient. We are not liable for anything that happens beyond our control which could result in delays.

CHRISTMAS DELIVERY – In line with the above information, cut off dates for Christmas 2021 are:

Sydney Metro – Thursday, 23rd December
WA and NT- Monday, 22nd November
Cairns, Townsville and TAS – Monday, 29th November
Greater NSW – Monday, 29th December
Mackay, Capricorn Coast, Wide Bay, Toowoomba, Sunshine Coast (QLD), Adelaide (SA), Bendigo, Geelong (VIC) – Monday, 6th December
Northern Rivers, Coffs Harbour, Port Macquarie, Newcastle, Central Coast, Wollongong, Canberra, Albury, Wodonga (NSW), Gold coast (QLD) Monday, 13th December
Melbourne & Brisbane Metro – Monday, 13th December
Any other location not specified above – Monday, 6th December

GENERAL CUT OFF DATES
The following are the delivery times if ordered before 10am Australian Eastern Standard Time, Monday- Friday.  Delivery times vary between locations and you should keep the following estimated delivery times in mind when placing your order to avoid disappointment.

Weekends and Public Holidays

The Hamper Spot delivers orders Monday – Friday between 9am and 5pm. The Hamper Spot does not deliver orders on Saturday, Sunday or on any Public Holiday. Orders placed on a Saturday, Sunday or a Public Holiday will be dispatched and shipped the next business day.

Special Events Deliveries

Separate terms and conditions apply to days of significance, special events and holidays which include (but are not limited to) Valentine’s Day, Mother’s Day and Christmas. Terms and Conditions pertaining to days such as these will be provided on the website for The Hamper Spot (www.thehamperspot.com.au).

Signature on Delivery

To ensure your order reaches the intended recipient, a signature is required upon delivery. It is The Hamper Spot’s strong recommendation that you do not authorise to leave the parcel unattended and if no one is home, a calling card left.

Should you choose to have the parcel left without a signature (e.g. on the front porch) you may do so by providing your delivery instructions at checkout. Please keep in mind that no responsibility is taken by The Hamper Spot should something happen to this parcel.

If delivery instructions are not provided by you at checkout and the intended recipient is not present at the time of delivery, a calling card will be left. The recipient (upon recipet of the calling card) is to organise an alternative time to have the parcel redelivered.  Re-delivery fees may apply.

When the parcel is delivered by Australia Post and no one is home to accept the delivery, a calling card will be left at the address advising that the goods may be picked up from the nearest Post Office.

Avoid disappointment – order early

Orders should be placed as soon as possible to enable The Hamper Spot to deliver your gift on your preferred delivery date. If a preferred delivery date is not specified, the default date of dispatch will be the day the order is placed, and the order will be delivered as per regular delivery times.

Address Types

Residential addresses: If the courier deems the residential address to which delivery is intended, to be unsafe or unsuitable for access, the order will be returned to dispatch and redelivery fees will apply.

Business, school and hospital addresses: Occupants at these addresses may redirect deliveries to mailrooms, front desks or reception. The Hamper Spot does not take responsibility for any failure on the part of the business, school or hospital in notifying the intended recipient of the delivery. Please be as specific as possible when providing address details.

Customer Obligations

Customers are required to:

  1. Provide a valid contact email and a telephone numbers when placing an order;
  2. Immediately notify The Hamper Spot of any discrepancies in the details provided by the customer concerning the intended recipient, including
    but not limited to, name, delivery address and contact details; and
  3. Proof read any personalised messages to be attached to gift hampers.

The Hamper Spot will not be held responsible for incorrectly delivered goods or goods which are not delivered or incorrect personalised messages arising out of the customer’s failure to meet their obligations outlined above or in these Terms and Conditions generally.

Alterations & Amendments to orders

Alterations and amendments to orders (including in respect of shipping addresses) must be advised to The Hamper Spot in writing via email to
contactus@thehamperspot.com.au and must be received by The Hamper Spot prior to the delivery being dispatched. The Hamper Spot will notify
customers if alterations have been accepted and processed along with any additional charges that apply. The Hamper Spot reserves the right to refuse alterations and amendments.

Cancellation of Orders

Cancellation requests must be made in writing via email to contactus@thehamperspot.com.au and must be received by The Hamper Spot a minimum of 24 hours prior to dispatch (see Terms and Conditions regarding dispatch and delivery). The Hamper Spot will notify customers if a cancellation
has been accepted and processed. The Hamper Spot reserves the right to refuse cancellations if orders have been prepared and/or dispatched. If a cancellation is authorised, The Hamper Spot will endeavour to refund any amount paid by the customer within 5 – 7 working days, or such other time as may be required by the customer’s bank/financial institution.

Liquor

The Hamper Spot supports the Responsible Service of Alcohol. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years.

Purchaser Representation: A gift with alcohol must only be ordered by customers aged 18 years or over. By ticking the ‘I agree’ button during the checkout process, the purchaser represents that they and the recipient, are over 18 years old. The purchaser accepts that it is an offence to falsely represent they are of legal age to purchase alcohol and to obtain alcohol on behalf of a person who is under 18 years.

Delivery: The recipient of a gift which contains alcohol must be 18 years or over. Upon delivery of gifts that include alcohol, the recipient maybe required to provide valid ID for proof of age and sign for the goods. Under no circumstances will a gift be left on delivery without a signature and (where requested and deemed appropriated by the courier) proof of age.

The maximum volume of alcohol in each gift cannot exceed 2 litres.

Substitution and Seasonal Availability

The Hamper Spot will aim to fulfil orders to equal product descriptions on the website. However, when that product is unavailable or out of season, The Hamper Spot reserves the right to substitute items where necessary. Any item that is replaced or substituted will be of equal or greater value to the original product.

Pricing & Transactions

All prices quoted, unless otherwise stated, are inclusive of GST and are in Australian Dollars (AUD). In the event that a customer is entitled to a refund, the refund will be made to the original credit card or PayPal account.

Discounts

Discounts apply to the product value and exclude the delivery charge. Discounts may not be combined with any other discounts. Discounts may not
be redeemed for cash or transferred. Customers entitled to a discount must enter the valid discount code prior to order payment and finalisation. Discounts will not be applied to an order after payment has been taken. All promotional codes are valid for one product per transaction only and for personal consumption only. Promotional codes cannot be used when creating a custom hamper. These terms and conditions apply in conjunction with any terms and conditions, written on or associated with, ‘the discount’.

Governing Law

The use of this website is governed by and construed in accordance with the laws of Australia. Any legal action arising out of its use shall be brought and enforced under the applicable Australian law. By using this site, you agree to submit to the jurisdiction of the courts of Australia and any legal action pursued by you shall be within the exclusive jurisdiction of the courts of Australia.

Trademarks, Copyrights & Restrictions

Material on any website owned, operated, licensed or controlled by The Hamper Spot, is solely for your personal, non-commercial use. Such material
may not be copied, reproduced, republished, modified, uploaded, posted, transmitted, or distributed in any way, including by e-mail or other electronic means, without the express prior written consent of The Hamper Spot.

Use of the materials on any other website or networked computer environment, or use of the materials for any purpose other than personal, non-commercial use is a violation of The Hamper Spot copyrights, trademarks and proprietary rights and is prohibited.

Force Majeure

The Hamper Spot is not liable for failure to perform obligations, including but not limited to, the fulfilment of an order or a delivery, if such failure occurs as a result of acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster) war, hostilities, civil war, rebellion, revolution, insurrection, military or usurped power, terrorist activities, government sanction, blockage, embargo, labour dispute, strike, theft, lockout or interruption or failure of electricity or telephone service or any other event or phenomenon beyond control of The Hamper Spot.
